Terms & Conditions Terms & Conditions for using content from the Chelmsford SkyCam:
  • These Terms & Conditions apply to any party who utilises content from the Chelmsford SkyCam in full or, in part or, provides a clickable index or link to content from the Chelmsford SkyCam within their own web resource.

 Definitions:

  • The Service is the Server on which the chelmsford.milliflora.com domain resides and which is responsible for providing and maintaining content for The Chelmsford SkyCam.
  • Content is web documents, images and other objects received from The Service that are appropriate to the Chelmsford SkyCam, whether used in full or in part.
  • The Client is a third party web site that redistributes by content or by links, content from The Service.

 The Client and The Service relationship:

  • A Client who uses content from The Service agrees that no contract shall exist or,
    no consideration shall pass so that effectively, The Service is provided in, and used in,
    good faith
    .
  • Henceforth, when utilising content from The Service, a Client has no duty to continue to use the content from The Service, and likewise, there is no liability on The Service to continue to supply content to the Client.
  • And that where a link to The Service is given by a Client, their is no guarantee that Content or The Service will be available (see guarantee below).
  • Where other information is provided by The Service, information can only be regarded as only a guide to local conditions and not, a statement of absolute fact.
  • Furthermore, and within the limits of the law, no party shall be liable for any losses incurred as the direct result of use, or failure to use correctly, The Service.
  • A Client may only utilise content from The Service with expressed permission (see contact details above).
  • Attempts to utilise The Service without prior consent, may result in the receipt of unpredictable content.

 Web Ethics:

  • The Service is provided as a means to monitor the sky conditions over the town of Chelmsford in Essex and is not intended for the surveillance of persons or property. Anything occurring within The Service that is specifically identifiable is already in clear public view.
  • The Service exists in accordance with the spirit of the free-and-democratic internet and therefore, the provider welcomes any party who participates in distribution of The Service to different nations and cultures through indexing and assimilation.
  • The Service provider will never distribute Client email addresses and other contact details; not even to so called, 'trusted third parties'. Furthermore, The Service provider considers Client's to have already opted-out from receiving promotional emails.
  • The Service provider recognises that some Service users will have special needs and therefore, takes reasonable measures to ensure that content is delivered within acceptable web standards.
  • Generally, The Service does not place cookie files on client browsers unless, it is necessary for the correct receipt of Content. Service traffic and usage monitoring is performed using standard log files on the server where The Service resides.
  • The Service provider does not support adult, pornographic and other dubious user base content providers; and The Service shall never be used as a portal to promote these.
  • If a Client is found using The Service in conflict with this ethics policy, then this agreement is liable to be voided and, the Client shall be notified that they must cease using or indexing The Service immediately.
  • Although the Service provider attempts to ensure that other third party services offered by The Service as clickable links are reputable in character, any user of The Service who follows a link, uses that third party service at their own risk.
  • Declaration for the United Kingdom Data Protection Act 1998 : Data obtained from the normal operation of the Chelmsford Skycam shall, for the the sake of the Act, be considered as being for personal and recreational use only.

 Intellectual property:

  • Copyright remains with The Service, however, a Client may consider that content is effectively copyright free. Accreditation should be given where applicable and should read: Courtesy of The Chelmsford SkyCam at chelmsford.milliflora.com
  • By using The Service, the Client is granted the right to store, reproduce and archive by whatever salient means, images and content from The Service in accordance with normal system housekeeping, however;
  • Content from The Service must be used by a Client on an as-received basis. Content may not be altered, defaced, re-branded or otherwise changed. With the exception of Images which may be resized, no other modifications may be made to content including, the use of client-side technologies such as DHTML and Flash. Unauthorised content modifications may result in the receipt of unpredictable content.
  • The Service provider has received permission to use and redistribute any third party content (trade marks, icons, etc) that may be embedded within the content. The Client shall inherit this permission.
  • Because of the need by The Service provider to audit traffic, a Client may only take their content from The Service's designated portal.

 Guarantee:

In using The Service, the Client can expect that The Service provider will take all reasonable steps to ensure that:

  • The Service is made available throughout the hours of local daylight, which is a period of time bound roughly between Civil Twilight.
  • Service equipment is maintained in good condition and, where necessary, alternatives and replacements are sought quickly. *
  • Images are kept up-to-date, free from artefacts and are accurately time stamped. *
  • Images are made available through the server between the stated online hours every day, including holiday periods. *
  • Necessary counter measures are in place to ensure system integrity.
  • Where appropriate, add reciprocal links are added to Client resources.
  • Should The Service be unavailable for a period of more than three days or, has ceased to function or, has ceased as a service, the Client will be informed of this by email.

* This excludes telecommunication downtime, power outages, loss of ISPs and web hosts, failure of cameras, computers and networking equipment, and any other unforeseen events that may inhibit the normal provision of The Service.
